9. Prices and Taxes

Prices displayed to consumers include applicable value-added tax where required by law. Any additional charges that apply to an order will be disclosed before the customer submits the order.

The final price shown during checkout includes the product price, applicable taxes, discounts, and any disclosed delivery charges.

You are not required to pay an additional charge that was not clearly disclosed before the order was submitted.

Prices may change at any time before a binding contract is formed. A later price change does not affect an order that has already been accepted.

10. Pricing and Listing Errors

If a product is displayed with an obvious pricing, description, or technical error, we may correct the error before accepting the order.

If we identify an error before the contract is formed, we may:

Decline the order and refund any payment already received.

We will not substitute a higher price or materially different product without your express agreement.

After a binding contract has been formed, any correction, cancellation, or challenge based on an error will be subject to applicable law. Nothing in this section creates an unrestricted right for hollertag.shop to cancel an accepted consumer order.

11. Technical Steps for Placing an Order

To place an order, you generally complete the following steps:

Select a product and any available options;
Add the product to the shopping cart;
Review the shopping cart;
Proceed to checkout;
Provide contact, billing, and delivery information;
Select an available delivery method;
Select an available payment method;
Review the order summary and total price;
Correct any errors using the available checkout controls; and
Submit the order using the button indicating that the order creates an obligation to pay.

Before submitting an order, you are responsible for checking that the selected products, quantities, variations, delivery address, billing details, and payment information are correct.

12. Formation of the Contract

Products displayed on hollertag.shop generally constitute an invitation for customers to submit an order and do not, by themselves, constitute a binding offer by hollertag.shop.

By submitting an order using the final checkout button, you make a binding offer to purchase the selected products.

After the order is submitted, you may receive an automated order acknowledgement. Unless the acknowledgement expressly confirms acceptance, it confirms only that we have received the order and does not yet constitute acceptance.

A binding purchase contract is formed when we:

Send an express order acceptance;
Send a shipping or dispatch confirmation; or
Dispatch the ordered products,

whichever occurs first.

If several products are included in one order, acceptance may apply separately to individual products.

We may decline an order before acceptance where there is a legitimate reason, including product unavailability, an obvious pricing error, unsuccessful payment authorisation, delivery restrictions, suspected fraud, or a breach of these Terms.

If an order is declined after payment has been collected, the relevant payment will be refunded without undue delay.

You must not use a payment method without the account holder’s authorisation.

16. Payment Security

Payment information is handled through Shopify and applicable payment service providers.

Although reasonable security measures are used, no online payment or electronic transmission method can be guaranteed to be entirely secure.

If you believe that a payment method has been used without authorisation, contact your payment provider and info@hollertag.shop promptly.

17. Delivery

Orders are delivered to the address provided during checkout.

Available destinations, delivery methods, estimated delivery periods, and applicable delivery conditions are described during checkout or in our Shipping Policy.

Delivery periods are generally estimates unless a binding delivery date has been expressly agreed. We will make reasonable efforts to deliver within the stated period.

You are responsible for providing an accurate and complete delivery address. If you notice an error, contact us immediately. We cannot guarantee that an address can be changed after an order has entered processing.

A delivery may be delayed by circumstances such as:

Carrier disruption;
Customs processing;
Severe weather;
Transportation disruption;
Public holidays;
Address problems;
Security or fraud checks;
Product availability issues; or
Other circumstances outside reasonable control.

Mandatory rights relating to late or failed delivery remain unaffected.

18. Partial Deliveries

Where reasonable and permitted by law, products from one order may be delivered in separate parcels.

A customer will not be charged additional delivery fees solely because hollertag.shop chooses to divide an order into multiple shipments.

Tracking information may be issued separately for each parcel.

19. Transfer of Risk

For consumer purchases, the risk of accidental loss or damage generally passes to you when you, or a third party nominated by you other than the carrier, physically receives the products.

If you independently appoint a carrier that was not offered by hollertag.shop, risk may pass when the product is handed to that carrier, where permitted by law.

This section does not affect claims against hollertag.shop or the carrier for loss, damage, non-delivery, or defective performance.

20. Retention of Title

Products remain the property of hollertag.shop until the purchase price has been paid in full.

The retention of title does not affect the transfer of risk to consumers under applicable law.

21. Delivery Problems

You should inspect the parcel within a reasonable time after delivery.

If a parcel or product arrives visibly damaged, incomplete, incorrect, or defective, contact info@hollertag.shop as soon as reasonably possible.

Please provide:

Your order number;
A description of the issue;
Photographs of the product;
Photographs of the packaging;
A photograph of the shipping label; and
Details of any missing products or components.

Failure to report visible damage immediately does not automatically remove mandatory consumer rights. Prompt notification helps us investigate the matter with the carrier and provide an appropriate solution.

22. Statutory Right of Withdrawal

Consumers in Germany and other countries within the European Union or European Economic Area generally have the right to withdraw from an online purchase within 14 days without giving a reason, subject to applicable legal exceptions.

For purchases of goods, the withdrawal period generally begins after the consumer, or a third party nominated by the consumer other than the carrier, receives the goods.

23. Exceptions to the Right of Withdrawal

The right of withdrawal may not apply where a legal exception applies, including certain contracts concerning:

Products manufactured according to the customer’s specifications;
Clearly personalised products;
Products liable to deteriorate or expire rapidly;
Sealed products unsuitable for return for health or hygiene reasons after the seal has been removed;
Products that have become inseparably mixed with other goods after delivery;
Sealed audio, video, or software products after the seal has been removed; and
Digital content where performance began after the consumer expressly consented and acknowledged the legally applicable loss of the withdrawal right.

An exception will be applied only where the legal requirements for that exception are satisfied.

24. Returns and Refunds

Returns and refunds are governed by our Return and Refund Policy.

Where a consumer validly withdraws from a contract, eligible payments will be refunded within the legally required period. We may withhold the refund until the returned products are received or the consumer provides evidence that they were sent back, where permitted by law.

Refunds are generally made using the original payment method unless another method is expressly agreed and does not create additional costs for the consumer.

Any voluntary return policy offered by hollertag.shop is additional to, and does not replace, statutory rights.

25. Statutory Rights for Defective Products

Consumers have statutory rights when products:

Are defective;
Do not possess the agreed characteristics;
Are unsuitable for their normal or agreed purpose;
Do not correspond to their description;
Are supplied in the wrong quantity;
Are incorrectly assembled where assembly is part of the contract; or
Otherwise fail to conform to applicable contractual requirements.

Subject to applicable law, available remedies may include:

Repair;
Replacement;
A reasonable reduction in price;
Termination of the contract; or
Compensation for qualifying loss.

Repair or replacement will be provided without additional cost and without unreasonable inconvenience where required by law.

Consumers in the European Union generally benefit from a minimum two-year statutory legal guarantee for new consumer goods. The specific period and remedies are governed by the law applicable to the purchase.

These statutory rights exist independently of the voluntary 30-day return policy and independently of any commercial manufacturer’s warranty.

26. Manufacturer Warranties

A product may be supplied with a voluntary manufacturer’s warranty.

Any manufacturer’s warranty is provided under the conditions stated by the manufacturer and is separate from the statutory rights owed by the seller.

A commercial warranty does not replace, restrict, or reduce your statutory rights concerning defective or non-conforming products.

Unless expressly stated, hollertag.shop does not provide an additional commercial guarantee beyond mandatory statutory rights and any specifically advertised voluntary policy.

27. Promotions and Discount Codes

Promotions, discount codes, vouchers, and special offers may be subject to additional conditions disclosed when the promotion is offered.

Unless otherwise stated:

A discount cannot be exchanged for cash;
Discounts apply only during the stated promotional period;
Discounts may apply only to eligible products;
Multiple discounts may not be combined;
A discount cannot be applied retrospectively to a completed order;

Promotions will not be administered in a manner that removes mandatory consumer rights.

28. Gift Cards and Store Credit

Where gift cards or store credit are offered, additional terms may be displayed at the time of purchase or issue.

Gift cards and store credit:

May be used only through the channels specified;
Cannot normally be exchanged for cash except where required by law;
Must not be resold or transferred for fraudulent purposes;

29. Reviews and User Content

You may have the opportunity to submit reviews, ratings, photographs, comments, suggestions, or other content.

You must ensure that submitted content:

Is accurate and based on genuine experience;
Does not infringe intellectual property, privacy, or personality rights;
Is not defamatory, threatening, discriminatory, or unlawful;
Does not contain malicious software;
Does not disclose another person’s confidential information;
Does not contain unauthorised advertising or spam; and
Does not misrepresent your identity or relationship with a product.

You retain ownership of content you create. By submitting content for publication, you grant hollertag.shop a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, translate, and distribute the content for operating and promoting the website and products, for as long as the content is lawfully retained.

This licence does not permit us to falsely attribute statements to you or materially alter the meaning of a review.

We may moderate, refuse, or remove content where reasonably necessary to comply with law, protect rights, maintain website integrity, or enforce these Terms.

30. Intellectual Property

The website and its contents, including text, graphics, product presentations, photographs, logos, icons, layout, software, and design elements, are protected by applicable intellectual property laws.

The store is hosted using Shopify’s commerce platform.

Your use of specific Shopify-operated services, including Shop or Shop Pay where available, may also be subject to Shopify’s applicable terms and privacy information.

34. Privacy and Cookies

We will take reasonable steps to minimise the effects of such an event and resume performance when reasonably possible.

If performance becomes impossible or is significantly delayed, customers retain any cancellation, refund, termination, or other rights provided by mandatory law.

38. Liability

hollertag.shop is liable without limitation:

For damage caused intentionally or through gross negligence;
For injury to life, body, or health caused by a negligent or intentional breach of duty;
Under mandatory product-liability law;
Where a guarantee has been expressly provided;
Where a defect has been fraudulently concealed; and
In any other circumstance where liability cannot legally be limited or excluded.

For damage caused by simple negligence, hollertag.shop is liable where an essential contractual obligation has been breached. An essential contractual obligation is an obligation whose performance is necessary for the proper performance of the contract and on which the customer may normally rely.

In cases of simple negligence involving an essential contractual obligation, liability is limited to damage that was foreseeable and typical for the contract at the time the contract was formed.

Subject to the mandatory exceptions above, liability for simple negligence involving non-essential contractual obligations may be excluded to the extent permitted by law.

These limitations also apply to the personal liability of employees, representatives, agents, and service providers acting on behalf of hollertag.shop.

Nothing in these Terms limits statutory remedies for defective goods, delayed delivery, non-delivery, withdrawal, refunds, or other mandatory consumer rights.

39. Business Customers

Where the customer is an entrepreneur rather than a consumer, additional restrictions permitted by commercial law may apply.

Business customers must inspect delivered goods within the legally applicable period and report defects in accordance with any mandatory commercial inspection and notification duties.

Any limitation applicable only to business customers will not apply to consumers.

40. Suspension and Termination of Access

You may stop using the website at any time.

We may restrict or terminate access to an account or website function where reasonably necessary because of:

A serious or repeated breach of these Terms;
Fraud or attempted fraud;
Security threats;
Unlawful conduct;
Abuse of promotions, returns, or payment systems; or

Termination of website access does not remove obligations or rights arising from an existing purchase contract.

This does not restrict the assignment of monetary claims or other rights where such a restriction would be invalid under applicable law.

We may transfer rights or obligations in connection with a legitimate business transfer, restructuring, or service arrangement, provided that the transfer does not reduce mandatory consumer rights.

44. Entire Agreement

These Terms of Service, together with the order confirmation, product information, Privacy Policy, Return and Refund Policy, Shipping Policy, and any additional conditions expressly agreed for an order, form the contractual framework between you and hollertag.shop.

If a specific order term conflicts with a general provision in these Terms, the specifically agreed order term generally takes priority.

45. Changes to These Terms

We may update these Terms to reflect legal, regulatory, technical, operational, or business changes.

The Terms applicable to a purchase are generally the version made available when the order was submitted.

Changes to these Terms will not retroactively alter an existing contract without your agreement or another valid legal basis.

The current version will be published on hollertag.shop with an updated revision date.

46. Governing Law

These Terms and contracts formed through hollertag.shop are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods where its exclusion is permitted.

If you are a consumer residing outside Germany, this choice of law does not deprive you of mandatory consumer protections available under the law of your country of habitual residence where those protections cannot be excluded by agreement.

47. Jurisdiction

For consumers, the legally competent courts are determined by applicable law.

A consumer may bring proceedings in the courts available under mandatory consumer-jurisdiction rules. Nothing in these Terms requires a consumer to bring a claim exclusively before a court that would not otherwise have jurisdiction.

For business customers, a place of jurisdiction may be agreed or determined in accordance with applicable commercial and procedural law.

48. Consumer Dispute Resolution

We aim to resolve customer complaints directly and fairly. Please contact info@hollertag.shop before pursuing formal proceedings so that we have an opportunity to investigate the matter.

Unless required by applicable law in a specific case, hollertag.shop is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.

The former European Online Dispute Resolution platform is no longer available and is therefore not linked in these Terms.

49. Protection of Mandatory Rights

No provision of these Terms is intended to exclude, waive, restrict, or replace rights that cannot legally be excluded.

If a provision conflicts with mandatory German or European Union consumer law, the mandatory legal rule takes priority.
